Terms of Service

These terms apply to your use of HyLife, including the website, the avatar customizer and the stream overlays (together, the "Service"). By logging in to or using the Service, you agree to these terms. If you don't agree, please don't use the Service.

1. The Service

HyLife is a free, fan-run tool that lets viewers of a live stream customize an avatar and show it on stream. It is provided as a hobby project. It is not made, endorsed or supported by Twitch, YouTube or Google.

2. Eligibility and accounts

You must be at least 13 years old, and old enough to use Twitch or YouTube where you live. You sign in with your Twitch or YouTube account, and you are responsible for activity under your account. When you use those platforms you also have to follow the Twitch Terms of Service and the YouTube Terms of Service.

3. Cosmetic items have no value

Avatar items and other unlocks are cosmetic only. They have no monetary value, can't be sold, traded, transferred or exchanged for money, and aren't property you own. Unlocking an item through a subscription, Bits, channel points or any other stream interaction is a fun extra. It is not a purchase from HyLife, and no refund, replacement or compensation is owed if an item changes, is removed or stops being available. Payments for subscriptions or Bits are between you and Twitch or YouTube, under their terms.

4. Acceptable use

You agree not to:

• break the law or the rules of Twitch or YouTube while using the Service;
• try to get unlocks you haven't earned, or exploit bugs or glitches;
• try to access other people's accounts, the admin tools or the server, or interfere with or overload the Service;
• use bots, scrapers or other automated means to access the Service; or
• use the Service to harass, impersonate or harm anyone.

We may remove unlocks, hide an avatar from the stream, or suspend or delete any account at our discretion, with or without notice, including for breaking these terms.

5. Your content on stream

Your username, display name, avatar and chat messages may appear on a public live stream and in its recordings. You give us permission to display them for that purpose. Recordings and clips are controlled by Twitch or YouTube and may stay available after you stop using HyLife.

6. Ownership

The HyLife name, logo, art, avatar items and software belong to HyLife or its licensors. You may use them only through the Service, for personal and non-commercial purposes.

7. Changes and availability

We may change, pause or shut down the Service, or any part of it, at any time and without notice. We don't promise the Service will be available, error-free or secure, or that your avatar or unlocks will be kept forever.

8. No warranty

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties or conditions of any kind, whether express, implied or statutory, including any implied warranties or conditions of merchantable quality, fitness for a particular purpose and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, HyLife and the people who run it will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, unlocks, profits, goodwill or enjoyment, arising out of or related to your use of (or inability to use) the Service, even if advised that such damages were possible. Our total liability for any claim related to the Service is limited to zero Canadian dollars (CAD $0), since the Service is provided free of charge. If that limit isn't enforceable, it is limited to CAD $10.

Nothing in these terms limits any right you have that can't be limited by law, including under Ontario's Consumer Protection Act.

10. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless HyLife and the people who run it from any claims, losses or costs (including reasonable legal fees) arising from your misuse of the Service or your breach of these terms.

11. Privacy

How HyLife handles your information is explained in the Privacy Policy.

12. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of Ontario, and you agree to their jurisdiction, unless the law where you live gives you the right to bring a claim somewhere else.

13. General

If any part of these terms is found to be unenforceable, the rest stays in effect. If we don't enforce a term right away, we haven't given up the right to enforce it later. These terms and the Privacy Policy are the entire agreement between you and HyLife about the Service. We may update these terms by posting a new version on this page. If you keep using the Service after that, you accept the new terms.
